Terms of Service Agreement
Welcome.  Kalyanamastu.com provide its services subject to the following   Terms of Service (TOS), which may be ammended from time  to time, without prior notice. 

Our Service:
Kalyanamastu.com is  intended to provide various services related to matrimony. The current services includes rich collection of profiles of prospective Brides and Bride Grooms; selection and access provision for wedding ceremony facilities; communication, greeting and gift delivery; and other related services.  It also provides personal / family web page hosting service.  Any new feature/s that augment or enhance the current service or release of new version of this service shall be subject to this TOS.  The user of this service need to obtain access to the WWW.

The Profile Advertiser:

To avail / use this service the Profile Advertiser agree to:

1. Furnish accurate, current and complete information as prompted by the registration form,   and
2. Maintain and promptly update the information to keep it accurate, current and complete.

If Kalyanamastu.com finds any information that the profile advertiser provided that is untrue, inaccurate, not current or incomplete,  Kalyanamastu.com reserves the right to suspend or terminate such account and refuse any and all current and future use of the services.

Privacy Policy:
The profile advertisers are guided by the Privacay Policy laid down by the company

User Conduct:
User shall  use Kalyanamasthu.com only for it's intended purpose.  He/She shall not post/publish/transmit through Kalyanamastu.com any material which is vulgar, obscene, abusive, threatening, defamatory, invasive of privacy or public rights and violates or infringes in any way upon the rights of others, or encourages or/and constitute a criminal offense, give rise to civil liability or otherwise violate any law. The user shall not solicit or advertise any product or service without Kalyanamasthu.com's prior approval.

Liability & Indemnification:
Users of Kalyanamasthu.com expressly agrees that the use of this service is at User's sole risk.  Neither Kalyanamasthu.com nor it's employees / associates make any warranty to the results that my be obtained from the use of Kalyanamastu.com or as to the accuracy, reliability and content of any information, service  or merchandise provide through Kalyanamasthu.com.

USER EXPRESSLY UNDERSTAND AND AGREE THAT Kalyanamasthu.com SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF Kalyanamasthu.com  HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE SERVICE; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICE; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF USER TRANSMISSIONS OR DATA; (iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE; OR (v) ANY OTHER MATTER RELATING TO THE SERVICE.

User agrees to defend, indemnify and hold Kalyanamasthu.com and it's directors / employees / associates / affiliates not responsible from and against all disputes and expenses thereof, arising out of the use of  by Kalyanamasthu.com user.

International:
User agree to comply with all applicable laws and governing rules of residing country, regarding transmission of any data and dealing with content online.  

Ownership and Liability:
Kalyanamasthu.com does not claim ownership of content that a user place on this site.   By submitting content to Kalyanamasthu.com for inclusion on the site, the user   expressly acknowledge that Kalyanamasthu.com does not pre-screen the content, but shall have the right but not the obligation in its sole discretion to refuse to post or remove any content that violates the TOS or is otherwise objectionable,or for any other reason which it feels is not in it's interests. User agree that user must evaluate, and bear all risks associated with, the use of any Content, including any reliance on the accuracy, completeness, or usefulness of such Content.  

Resale:
User agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service.

Modifications:
Kalyanamasthu.com  reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice and shall have right to change or modify the terms and conditions applicable to Users' use of Kalyanamasthu.com.   These changes/modifications may result in imposition of new conditions, change of fees and charges. Kalyanamasthu.com  shall not be liable to any user or to any third party for any modification, suspension or discontinuance of the Service.

Termination:
User agree that Kalyanamasthu.com, in its sole discretion, may terminate user's profile / account, use of the Services and remove and discard any Content within the Service, for any reason, including, without limitation, for lack of use or if Kalyanamasthu.com believes that the user has violated or acted inconsistently with the letter or spirit of the TOS. Kalyanamasthu.com may also in its sole discretion and at any time discontinue providing the Service, or any part thereof, with or without notice. User agree that any termination of user access to the Service under any provision of this TOS may be effected without prior notice, and acknowledge and agree that Kalyanamasthu.com may immediately deactivate or delete user's profile / account and all related information and files and/or bar any further access to such files or the Service. Further, user agree that Kalyanamasthu.com shall not be liable to you or any third-party for any termination of your access to the Service.

Advertisements and Promotions:
Kalyanamasthu.com runs advertisements and promotions on the Site. Users' correspondence or business dealings with, or participation in promotions of, advertisers found on or through the Service, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between the user and such advertiser. User agree that Kalyanamasthu.com shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such advertisers on the Service.

The Service may provide, or third parties may provide, links to other World Wide Web sites or resources. Because Kalyanamasthu.com has no control over such sites and resources, user acknowledge and agree that Kalyanamasthu.com is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any Content, advertising, products, or other materials on or available from such sites or resources. User further acknowledge and agree that Kalyanamasthu.com shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Content, goods or services available on or through any such site or resource.

Proprietary Rights:
User acknowledge and agree that the Service and any necessary software used in connection with the Service ("Software") contain proprietary and confidential information that is protected by applicable intellectual property and other laws. User further acknowledge and agree that Content contained in sponsor advertisements or information presented to user through the Service or advertisers is protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws. Except as expressly authorized by Kalyanamasthu.com or advertisers, you agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on the Service or the Software, in whole or in part.

Kalyanamasthu.com grants the user a personal, non-transferable and non-exclusive right and license to use the object code of its Software on a single computer; provided that user do not (and do not allow any third party to) copy, modify, create a derivative work of, reverse engineer, reverse assemble or otherwise attempt to discover any source code, sell, assign, sublicense, grant a security interest in or otherwise transfer any right in the Software. user agree not to modify the Software in any manner or form, or to use modified versions of the Software, including (without limitation) for the purpose of obtaining unauthorized access to the Service. User agree not to access the Service by any means other than through the interface that is provided by Kalyanamasthu.com for use in accessing the Service.

DISCLAIMER OF WARRANTIES:

USER EXPRESSLY UNDERSTAND AND AGREE THAT:

(a) USE OF THE SERVICE IS AT USER'S SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. Kalyanamasthu.com EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

(b) Kalyanamasthu.com MAKES NO WARRANTY THAT (i) THE SERVICE WILL MEET USER REQUIREMENTS, (ii) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (iii) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE, (iv) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS, AND (V) ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED.

(c) ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS DONE AT USERS OWN DISCRETION AND RISK AND THAT USER WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO HIS/HER COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.
(d) NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY USER FROM Kalyanamasthu.com OR THROUGH OR FROM THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TOS.

EXCLUSIONS AND LIMITATIONS:

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS  MAY NOT APPLY TO YOU.

SPECIAL ADMONITION FOR SERVICES RELATING TO FINANCIAL MATTERS:
If user intend to create or join any service, receive or request any news, messages, alerts or other information from the Service concerning companies, stock quotes, investments or securities, please read the above Sections  again. They go doubly for you. In addition, for this type of information particularly, the phrase "Let the investor beware" is apt. The Service is provided for informational purposes only, and no Content included in the Service is intended for trading or investing purposes. Kalyanamasthu.com shall not be responsible or liable for the accuracy, usefulness or availability of any information transmitted via the Service, and shall not be responsible or liable for any trading or investment decisions made based on such information.

NOTICE:
Notices to user may be made via email. The Service may also provide notices of changes to the TOS or other matters by displaying notices or links to notices to user generally on the Service.

Kalyanamasthu.com respects the intellectual property rights of others and we ask our users to do the same. Please refer our copyright policy for more details.

GENERAL INFORMATION:
The TOS constitute the entire agreement between user and  govern the use of the Service, superceding any prior agreements between user and Kalyanamastu.com (including, but not limited to, any prior versions of the TOS). User also may be subject to additional terms and conditions that may apply when the user use affiliate or other Kalyanamasthu.com, third-party content or third-party software. The TOS and the relationship between user and Kalyanamasthu.com shall be governed by the laws of India without regard to its conflict of law provisions. User and Kalyanamasthu.com agree to submit to the personal and exclusive jurisdiction of the courts located within the county of India. The failure of  Kalyanamasthu.com to exercise or enforce any right or provision of the TOS shall not constitute a waiver of such right or provision. If any provision of the TOS is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the TOS remain in full force and effect. User agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or the TOS must be filed within one (1) year after such claim or cause of action arose or be forever barred. The section titles in the TOS are for convenience only and have no legal or contractual effect.
